Got rear ended today?
My missis got rear ended today while she was stationary, at about 40mph, in the Transit (luckily not the chally). Thank god the damage was just the rear step (big bugger it is too) and bumper. His car is a right off. The Bananarama! did a runner. He did finally turn himself in this evening to a cop shop about 5 miles away. Is there anything I can get him done for ie leaving the scene or such like. I am not worried about claiming really as it will end up costing me more for the insurance and no claims too. Have you got any advice Guys 
Road Collision
'Owing to the presence of a motor vehicle on a road an accident occurs whereby:
damage is caused to any vehicle other than the offending vehicle,
injury is caused to any person other than the driver of offending vehicle,
damage is caused to any property other than the offending vehicle,
In this instance the driver must STOP and provide his details to any person requiring these details.'
He has failed to stop at a road accident, but he has not failed to report the accident if he reported it at a police station within 24 hours.
So in this case he has appeared to committed one of the above offences as well as due care and attention (maybe document offences) You can make a complaint to the police for this matter, provided your wife is willing to make a statement and go to court. Independent witnesses is helpful, incase he has 'hire a witness mates'.
However the police can go down the road of cautioning him for any offence, but he must accept responsibility.
You could also consider a private prosecution if the police don't take action. The potential re-course is far greater that way. Hope this helps.

Thanks for that yes my wife will pursue all the way. I have just spoken to a friend in the force and he confirms your thoughts. Sorry to hear this. I'll bet for sure he was on his phone. Exact time of incident,get police to seize his phone and check his call records with phone provider. Another offence for him.

You have to ask yourself what he was worried about the Police finding when he ran away. Or if the person that went to the Police Station was the same person driving the car at the time of the crash.
If he is insured I don't think I would take it through the courts myself considering only minor damage to your vehicle. It's not worth the hassle. You will probably only get your insurance excess back and nothing more.

Thanks for the advice guys, yes dave we are going to check who went to the police station verses who was driving. My wife is not great as she had a pre existing condition (shermans disease I think its called). I would'nt bother with court....More hassel than its worth probably.
I'd tie him to the back of the transit and drag him for a mile or so!
