ebay help (Arrrghhh)

after my last adventure on ebay with a non paying bidder (now banned lol)

i now have a new problem with a headlamp i sold. see item here:

he is saying its not as described as there is scratches on the face and a scrap to the left of the washer jet cover.

he wont's me to have the lamp back and pay for the return postage!

ebay clearly says that used items are not to be expected in new condition (but i think ebay would say the opposite in the buyers section lol)

also at the bottom of the listing it stats no returns.


let me no if you think? if am wrong?? or he is being a typical porker owner who don't wanna spend the dough on a 600 pound headlamp???

The listing clearly states :





The headlights have no stone chips or cracks at all there are some very minor scratches when studied as can only be expected from use on the face. These are hardly noticeable & could be polished/machined out with a buffer but nothing serious at all other than that this would be an ideal upgrade/replacement for cracked/stone chipped, or even accident damaged headlights on your beloved Porsche.







This item was clearly listed as "used".



eBay also advices buyers, within the safety centre to not expect second hand items, from privates sellers to be in new condition but must be usable for the purpose intended and not affect its function (if any).



The item sold clearly does the above.



Also the mark of which you are not happy with (approx' 10mm to the left of the washer jet cover, when facing the face of the light), can clearly be seen in the ebay listing pictures.



In no way does my description try to trick the buying into thinking that they are buying an immaculate as new condition light.



At the end of the day, as you well know you have purchased a £600 plus (when new) headlamp off an auction site, from a private seller for £141.11.

Pete,
Think your advert was truthful and described well. Think the buyer is just trying it on. If he doesn't want it, tell him its his responsibility to package well & post back to you.
Warn him,you will need to charge him 10%-15% handling fee, due to lost potential bidders & inconvenience of re listing

How confident are you that no-one has taken a pin to the box....

I think you've done your bit, Pete. It's over £400 off list at the end of the day. If it was as new in the box, he would've paid more for it.

To be honest, I feel that 'as new' means just one thing, as good as new or, unidentifiable when sat next to a new one. An item can be used, and as new, it can also be used, and scratched and therefore not 'as new'.

When I buy things off the 'bay described 'as new', I expect them to be perfect, or, 'as new'. The fact he only paid £141 doesnt mean much. There may not have been many bidders on it, and he may have thought he bagged just as big a bargain as you did with the dunkies.

Don't let the cammeraderie on this board blind you to other possibilities about the buyers perception. Keep talking to him and get it sorted. There has to be some middle ground.

Anyone that buys something without seeing, it for real in the flesh, is intitled to send it back (at their own expense) for a full refund. That is the law. They don't even need a reason.

But you don't pay their postage costs and neither do they pay any costs you might have due to having to re-list the item.

yea understand what yours saying guys, but at the end of the day there is nearly 2 paragraphs saying its got scratches that could be polished out. any way i haven't heard no more from him yet, so ill see what he says.

yes he has payed though paypal, so the money wont totally clear until 21 days or once he has left a good feedback (lol).

Still, it sounds about par for the course for a Porker owner...

Play it by the book Pete, remain courteous and you won't go wrong, I know the feeling is that you want to go around to the guy's house and punch his lights out for being a tosser, a lot of Porsche owners out there simply can't afford to run the cars properly and want everything on the cheap, I would suggest you forget trying to do any of them a favour in the future.

I would be chuffed with a part like that at a quarter of the list price.

Not for a private listing methinks- distance selling does not apply

Hes got very good feedback Pete so looks like he buys and sells a lot - also if he leaves you a neg its really going to pull your rating down

I think you listed it fairly - although the only argument he has is the "as new" bit

To resolve it I would offer him a smallish discount to keep it

failing that get it collected(I can help with that) refund him and relist - you may even get more for it!

Just had a more detailed look at his negative feedback-
Quite a few in 12 months and mainly for HIM mis - describing stuff

I doubt he wants to collect another Neg from Pete so if he has any sense will resolve this amicably
