If the police do charge him then more than likely the claim will go in your favour. This will also apply if it can be proven he was on your side of the road.

Yep.......the Police are key in this I'd think!
If they can't prosecute though..........I think unfortunately (as insurance is an ass) it will go in his favour!
He was present on the road that your car entered.......as such if excess speed cannot be proven it may be found in his favour or 50:50.
Cue his claims for X, Y and Z as he sounds like an upstanding citizen!
My friend was done by someone as he exited a junction. She indicated, slowed down and at the last moment changed her mind.........T boned him!
Admitted she made a mistake at the scene.......then changed her mind on paper........argued the toss, and as she was present on the road and he pulled out it went in her favour!

Glad you are All OK...... It can take time.... It Is different here. The police have to. Be called to any incident.... Statements are made, and a charge laid then an there by the police....
Andy, Dave is about right the police will look at all aspects, but just because it's a modified car doesn't necessarily make that one in the wrong.
Insurers will mostly ask the police for copies of reports, which will have their recommendations as to who is to blame.
If your wife pulled out and could see it was clear, that may suggest the other car was going too fast and therefore out of sight when the Jeep started to pull out. Time and distance stuff.
Insurers will be the ultimate deciders, as it is their money, and it can take time. the bigger the monies involved the longer it will take.
It will be a bit of a time thing, but my advice is to KEEP A DIARY of everything now, especially how injuries feel every day, even if just a few lines, and keep receipts for all expenses resulting from this, taxi fares, parking at hospital, lost appointments which you've paid for etc etc.
I know this as Jack got knocked off his bike 2 weeks ago, and already we are struggling to remember how bad his injuries were, and he wont get seen by the insurance doctor for several weeks. Our case is a bit simpler as the driver has admitted liability, but even this is quite time consuming.
Best of luck, stick with it and write stuff down.

Thanks for all the kind words guys. I also appreciate the advice as well.
Here's a few more pics. The only road Tyre mark is the one in the picture below. I believe this is from my off-side rear wheel where it was spun round the 90-110 degree's. If its not my wheel then its his, either way it shows we where either on my side of the road or on the white line. He was well into our side of the road when he came round the bend.
You can see in the mirror how far around the sweeping bend you can see. There was no lights at all at the time of exit.
Sorry to hear about this Andy, it sucks. For what it's worth I got knocked off my bike by a van and sustained injuries, clear-cut, loads of witnesses, driver admitted blame, but still took 3 1/2 years to get paid out.
Keep a diary and take loads of pics.
Just had a letter from the insurance that the other lads insurance has taken full liability. All those photo's, diagrams, length measurements and descriptions paid off in the end. The best I was hoping for lately was 50/50 so this is a welcome bonus.
